Terms of Service

The agreement governing your use of the Asobo Education platform. We are committed to transparency, safety, and your trust.

1. Acceptance of Terms

By creating an account or using the Asobo Education platform (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a school or district, you represent that you have authority to accept these terms on their behalf.

2. Eligibility

  • Adults aged 18 and older may create teacher, parent, or administrator accounts.
  • Users aged 13–17 may use the platform with parental or school consent.
  • Children under 13 may only use the platform through a parent-managed family account or a school-authorized classroom account, in compliance with COPPA.

3. Account Types

Family accounts:

  • Created and managed by a parent or guardian
  • The parent controls child profiles and retains full authority over their child’s data

Classroom accounts:

  • Created by a teacher or school administrator
  • Student access is managed by the teacher or school
  • The school retains ownership and control of student education records

4. Acceptable Use

  • The Service is intended for educational purposes only.
  • You agree not to misuse the platform, attempt unauthorized access, or interfere with other users’ experience.
  • You agree to provide accurate information during registration and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials.

5. Student Data Ownership

  • Schools and parents retain ownership of student data at all times.
  • Asobo processes student data as a service provider, solely for the educational purposes described in our Privacy Policy.
  • We do not claim ownership of student education records.
  • Schools and parents may request export or deletion of student data at any time.

6. Intellectual Property

All content, software, trademarks, and intellectual property on the Asobo platform are owned by Asobo Education, Inc. or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. Educational content generated for your use within the platform is provided for personal or classroom educational use only.

7. Payment Terms

  • Paid subscriptions are billed through Stripe on a monthly or annual basis as selected.
  • Free trials automatically convert to paid subscriptions unless canceled before the trial ends.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support@asoboeducation.com for assistance.

8. Data Handling & Compliance

Our data practices are described in our Privacy Policy. We are committed to handling data in accordance with FERPA and COPPA. Schools and districts may request a Data Processing Agreement (DPA) by contacting legal@asoboeducation.com.

9. Termination

  • We may suspend or terminate your account if you violate these terms or misuse the Service.
  • Users may delete their account at any time. Upon deletion, personal data will be removed in accordance with our Privacy Policy.
  • Schools may terminate their use of the Service and request deletion of all associated student data.

10. Disclaimer & Limitation of Liability

The Service is provided “as is” without warranties of any kind, express or implied. Asobo Education does not guarantee that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, Asobo Education’s total liability for any claims arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Asobo Education, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) any content or data you submit to the Service that infringes the rights of a third party. This section does not apply to schools or districts to the extent prohibited by applicable law.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. For schools and districts located in New York, the rights and duties of the parties shall also be governed by New York Education Law Section 2-d and its implementing regulations, to the extent applicable.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • Arbitration shall take place in New York, New York, or remotely at the election of either party.
  • Each party shall bear its own costs; arbitration fees shall be shared equally.
  • The arbitrator’s decision shall be final and binding.
  • Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis, not as a class, consolidated, or representative action.
  • Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for the protection of intellectual property rights or confidential information.

Exception for schools and districts: If you are a school, district, or government entity that cannot legally agree to arbitration or class action waivers, this section shall not apply to you. Disputes will instead be resolved in the state or federal courts located in New York County, New York.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify users of material changes by email or by posting a prominent notice on our platform. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. The effective date and version number are displayed at the top of this page.
