By creating an account or using the Asobo Education platform (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a school or district, you represent that you have authority to accept these terms on their behalf.

All content, software, trademarks, and intellectual property on the Asobo platform are owned by Asobo Education, Inc. or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. Educational content generated for your use within the platform is provided for personal or classroom educational use only.
Our data practices are described in our Privacy Policy. We are committed to handling data in accordance with FERPA and COPPA. Schools and districts may request a Data Processing Agreement (DPA) by contacting legal@asoboeducation.com.
The Service is provided “as is” without warranties of any kind, express or implied. Asobo Education does not guarantee that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, Asobo Education’s total liability for any claims arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Asobo Education, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) any content or data you submit to the Service that infringes the rights of a third party. This section does not apply to schools or districts to the extent prohibited by applicable law.
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles. For schools and districts located in New York, the rights and duties of the parties shall also be governed by New York Education Law Section 2-d and its implementing regulations, to the extent applicable.
Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Exception for schools and districts: If you are a school, district, or government entity that cannot legally agree to arbitration or class action waivers, this section shall not apply to you. Disputes will instead be resolved in the state or federal courts located in New York County, New York.
We may update these Terms of Service from time to time. We will notify users of material changes by email or by posting a prominent notice on our platform. Continued use of the Service after changes take effect constitutes acceptance of the updated terms. The effective date and version number are displayed at the top of this page.
