1. Introduction

Asobo Education, Inc. (“Asobo,” “we,” “us,” or “our”) operates a K-12 adaptive learning platform. This Privacy Policy explains how we collect, use, disclose, and protect information from users of our platform, including students, parents, teachers, and school administrators. We are committed to complying with the Family Educational Rights and Privacy Act (FERPA), the Children’s Online Privacy Protection Act (COPPA), and applicable state privacy laws.

2. Information We Collect

Account information:

  • Name, email address, and password (or OAuth credentials)
  • Account type and role (student, teacher, parent, administrator)
  • School and district affiliation (for classroom accounts)

Student data (collected via school or parent authorization):

  • Student name, grade level, and age
  • Learning progress, quiz responses, skill mastery, and time-on-task
  • Adaptive learning preferences and engagement data

Usage data:

  • Pages visited, features used, and device/browser information
  • Information from cookies and similar technologies (see our Cookie Policy)

Payment data: Subscription and billing information is processed by Stripe. We do not store credit card numbers on our servers.

3. How We Use Your Information

  • To provide, maintain, and improve our adaptive learning platform
  • To personalize the learning experience for each student
  • To generate progress reports for teachers, parents, and administrators
  • To communicate with you about your account, updates, and support
  • To comply with legal obligations

Our Commitments:

  • ✓ We do NOT sell student personal information to anyone.
  • ✓ We do NOT use student data for targeted advertising.
  • ✓ We do NOT use student data to build marketing profiles.

4. Student Data & FERPA/COPPA Compliance

When Asobo is used by a school or district, we act as a “school official” with a legitimate educational interest under FERPA. Student education records are used solely for the educational purposes authorized by the school.

For students under 13, we rely on the school’s authorization to collect information as permitted under COPPA, or we obtain verifiable parental consent for family accounts. Student data is used exclusively for educational purposes as described in Section 10: Student Data Privacy below.

5. Data Sharing

We share data only with third-party service providers (“subprocessors”) that are necessary to operate our platform. Each subprocessor is contractually required to protect data and use it only for the specified purpose. See the Subprocessors list on our Trust Center for the complete list.

We may disclose information if required by law, legal process, or to protect the safety of our users.

6. Data Retention & Deletion

  • Personal data is retained while your account is active.
  • You may request deletion of your data at any time by contacting us.
  • When a school contract or pilot ends, associated student data is deleted within 30 days unless the school requests otherwise.
  • Parents can request deletion of their child’s data at any time.
  • Anonymized, aggregate data (which cannot identify individuals) may be retained for platform improvement.

7. Security

We protect your data with encryption in transit (TLS 1.2+) and at rest (AES-256), role-based access controls, and regular security reviews. Our infrastructure is hosted on Google Cloud Platform, which maintains SOC 1/2/3, ISO 27001, and FedRAMP certifications. For details, see the Security section on our Trust Center.

8. Your Rights

You have the right to:

  • Access your personal data
  • Correct inaccurate information
  • Delete your account and associated data
  • Export your data in a portable format
  • Opt out of marketing communications

9. Children’s Privacy

We do not knowingly collect personal information from children under 13 without obtaining appropriate consent from a parent, guardian, or school. If we learn that we have collected information from a child under 13 without proper consent, we will delete it promptly.

10. Student Data Privacy

This section explains how Asobo Education handles data relating to K-12 students, in compliance with the Family Educational Rights and Privacy Act (FERPA), the Children’s Online Privacy Protection Act (COPPA), and applicable state student privacy laws.

10a. What Student Data We Collect

  • Identity information: First name, last name, grade level, age (provided by parent or school)
  • Learning data: Quiz and assessment responses, scores, skill mastery levels, learning progress, time-on-task
  • Adaptive learning signals: Difficulty preferences, hint usage, engagement patterns used to personalize instruction
  • Classroom association: Which classroom, teacher, and school the student belongs to

We do not collect Social Security numbers, biometric data, financial information, or precise geolocation from students.

10b. How Student Data Is Used

Student data is used solely for educational purposes:

  • Delivering adaptive, personalized learning experiences
  • Tracking progress and generating reports for teachers and parents
  • Identifying areas where a student needs additional support
  • Improving the educational effectiveness of our platform

10c. What We Do NOT Do With Student Data

  • We do not sell student data to anyone, ever.
  • We do not use student data for targeted advertising.
  • We do not profile students for non-educational purposes.
  • We do not share student data with social media companies.
  • We do not use student data to train third-party AI models.

10d. Who Can Access Student Data

  • The student’s assigned teacher(s)
  • The student’s parent or guardian
  • School and district administrators
  • Authorized Asobo staff with a legitimate need-to-know (e.g., support, engineering)

Access is controlled through role-based permissions. All access is logged.

10e. AI and Student Data

Our platform uses AI to generate personalized learning content (questions, explanations, hints). When AI processes student responses, we send only the educational content needed — no personally identifiable information (PII) is sent to AI providers. Our AI subprocessors do not retain student data and do not use it for model training.

10f. School Authority & Parental Rights

Schools: When a school or district provides access to Asobo, the school acts as the authorizing entity under FERPA and may consent on behalf of parents for the collection of student data for educational purposes under COPPA. Schools retain ownership and control of all student education records.

Parents: For family accounts, the parent or guardian provides consent and retains full control over their child’s data. Parents have the right to:

  • Review their child’s data at any time
  • Request corrections to inaccurate data
  • Request deletion of their child’s data
  • Withdraw consent and close the child’s account

10g. Student Data Retention

  • Student data is retained while the student’s account is active.
  • Upon account deletion or school/parent request, student data is deleted within 30 days.
  • When a school pilot or contract ends, all associated student data is deleted within 30 days unless the school requests an extension.
  • Anonymized, aggregate data (with no way to identify individual students) may be retained for platform improvement.

11. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to know: You may request the categories and specific pieces of personal information we have collected about you, the sources, the business purposes, and the categories of third parties with whom we share it.
  • Right to delete: You may request deletion of your personal information, subject to certain exceptions (e.g., legal obligations, completing a transaction).
  • Right to correct: You may request correction of inaccurate personal information.
  • Right to opt out of sale or sharing: We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
  • Right to non-discrimination: We will not discriminate against you for exercising your privacy rights.

To exercise these rights, contact us at privacy@asoboeducation.com. We will verify your identity before processing your request and respond within 45 days.

Categories of personal information collected (per CCPA categories): Identifiers (name, email), education information (learning records, grades), internet activity (usage data, device info), and commercial information (subscription status). We do not collect biometric data, geolocation, or sensitive personal information as defined by CCPA.

12. New York Education Law Section 2-d

For schools and districts in New York State, the following additional provisions apply in accordance with NY Education Law § 2-d and its implementing regulations (8 NYCRR Part 121):

  • Asobo will not sell or release students’ personally identifiable information (PII) for any commercial purpose.
  • Parents have the right to inspect and review the complete contents of their child’s education record maintained by Asobo.
  • State and federal laws protect the confidentiality of PII, and safeguards associated with industry standards and best practices (including encryption, firewalls, and password protection) are in place to protect PII.
  • Asobo has implemented an Education Law 2-d compliant Data Security and Privacy Plan, available upon request.
  • A list of subprocessors with access to student data is maintained on our Trust Center.
  • In the event of a breach or unauthorized release of PII, Asobo will notify the educational agency in the most expedient way possible and without unreasonable delay, consistent with the requirements of 8 NYCRR § 121.10.

Parents’ Bill of Rights (NY): Pursuant to Education Law § 2-d, parents and eligible students are entitled to the following:

  1. A student’s PII cannot be sold or released for any commercial purposes.
  2. Parents have the right to inspect and review the complete contents of their child’s education record stored or maintained by an educational agency.
  3. State and federal laws protect the confidentiality of PII, and safeguards are in place to protect data.
  4. A complete list of all elements of PII collected by Asobo is available upon request and detailed in this Privacy Policy.
  5. Complaints about possible breaches of student data may be directed to the educational agency and/or the New York State Education Department.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify users of material changes by email or by posting a prominent notice on our platform. The effective date and version number are displayed at the top of this page.
